At present, China has gradually launched the normative standard system of the pharmaceutical industry, but there is still a certain distance from the international standards. The lack of industry standard system leads to the situation that the packaging of pharmaceutical products is neither good nor bad. Finally, there are drawbacks in the drug circulation system. Pharmaceutical products have been mainly sold in hospitals for a long time, and the drugs sold in pharmacies account for only a small part of the total. This situation restricts the direct participation of drugs in market competition and restricts the development of pharmaceutical packaging

Among them, trademark, patent, copyright, anti unfair competition, consumer protection, environmental protection, product quality standards and other legal issues are closely related to pharmaceutical packagingit is understood that in China's trademark registration system, voluntary registration is the main method, but compulsory registration is given to human drugs and tobacco products, because human drugs are related to the life, health and safety of ordinary people. In other words, drugs with unregistered trademarks will be regarded as fake drugs when they enter the market. In China's patent law, the edible commodities that apply for design protection mainly include food and alcohol products, while the pharmaceutical packaging applies for conceptual design protection less, but the pharmaceutical packaging of specialty drugs, high-grade drugs and drugs that can be given as gifts must pay attention to design patents.
